🤝 1. Acceptance of Terms
By downloading, installing, or using the EchoListen application ("the App") on an iOS device, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the App.
EchoListen is provided to help users practice language pronunciation and feedback loops. These Terms apply to all users, including guest users and registered users.
👤 2. Accounts and Eligibility
You can use certain basic features of the App (such as Solo Mode) as a guest without creating an account. However, to access advanced features (such as Shadowing Mode and Speech Pro Mode), you must register and sign in.
- Account Security: If you create an account via third-party authentication (Google/Apple Sign-In), you are responsible for maintaining the confidentiality of your credentials.
- Account Deletion: You may request the deletion of your account and all associated data at any time via the App's account settings.
⚡ 3. Usage Rules and AI Credits
Advanced modes in EchoListen rely on artificial intelligence (AI) services. To prevent abuse and manage costs, the App uses a credit system:
- Free Tier Credits: Free users receive a limited allowance of daily credits, which automatically resets each day. Daily credit allowances may vary by country or region.
- Credit Limits: We reserve the right to modify the daily credit limits at any time via Cloud Remote Config updates.
- Abuse Prevention: You agree not to use bots, scrapers, or other automated mechanisms to generate voice synthesis requests or artificially consume credits.
💳 4. Pro Subscriptions and Billing
You may purchase a Pro subscription to receive a higher daily credit allowance and additional features.
- Apple In-App Purchases: All transactions, purchases, and subscriptions on iOS are processed securely through Apple's In-App Purchase system and are subject to the App Store Terms of Service.
- Cancellations and Refunds: Subscription cancellations and refund requests must be managed through your Apple ID / App Store account settings according to Apple's refund policies. We cannot directly issue refunds for iOS purchases.
🎙️ 5. Voice Processing & AI Features
Your privacy is extremely important to us. EchoListen processes audio differently depending on the selected practice mode:
- Solo Echo Mode: All audio recordings and playback are processed entirely locally on your device. No voice data or recordings are uploaded, stored, or transmitted to any servers.
- Advanced AI Modes (Shadowing & Speech Pro): To provide real-time similarity scoring, corrective modeling, and daily Tutor Reports, your voice recordings (and target scripts) are transmitted securely via HTTPS to third-party artificial intelligence services (specifically Google Gemini APIs).
- Stateless Processing: All uploaded voice recordings are processed transiently in-memory by third-party APIs for evaluation and are not stored persistently or saved on our servers or by third-party APIs after processing.
- Local Practice History: If you choose to save recordings to your Practice History, the audio files are saved locally on your device's browser database (IndexedDB) and remain entirely on your own device.

THE APP AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
WE EXPRESSLY DISCLAIM ANY WARRANTIES REGARDING THE ACCURACY, CORRECTNESS, COMPLETENESS, OR RELIABILITY OF THE AI-GENERATED INSIGHTS, TUTOR CORRECTIONS, OR VOICE SYNTHESIS SCORES.
⚖️ 7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ECHOLISTEN AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
📝 8. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make updates, the "Last updated" date at the top will be updated. Your continued use of the App following changes constitutes acceptance of the new Terms.
🍎 10. Apple App Store EULA Addendum
This section applies to users who download and access the App on Apple iOS devices through the Apple App Store.
- Acknowledgement: You acknowledge that this agreement is concluded between you and EchoListen only, and not with Apple, Inc. EchoListen, not Apple, is solely responsible for the App and the content thereof.
- Scope of License: The license granted to you for the App is a non-transferable license to use the App on any Apple-branded products that you own or control, and as permitted by the Usage Rules set forth in the App Store Terms of Service.
- Maintenance and Support: EchoListen is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
- Warranty: EchoListen is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App (if any); and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.
- Product Claims: You acknowledge that EchoListen, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of that App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
- Intellectual Property Rights: You acknowledge that, in the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, EchoListen, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.
- Legal Compliance: You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-Party Terms: You must comply with applicable third-party terms of agreement when using the App (e.g., your wireless data service agreement).
- Third-Party Beneficiary: You acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that, upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
